Visual artist loses copyright case against Berlingske

It is not a breach of copyright when a painting appears in the background of a photograph which is published in the newspaper.

That was decided by Copenhagen City Court on Monday in a case where Berlingske was sued for bringing a picture of investor Peter Warnøe sitting in front of a painting of poppies.

The painting was painted by the artist Jorit Tellervo, and she has thus not been successful in the lawsuit she filed against editor-in-chief Tom Jensen, Berlingske Media and the newspaper's photographer.

BKF's lawyer and head of secretariat Klaus Pedersen was invited to Kulturen on P1 on Monday. He was surprised by the outcome of the trial.
